Social media has revolutionized the way we communicate and share information. These changes have raised complex legal issues that are relevant to lawyers across all areas of practice. In this seminar, we will explore these issues and the governing legal principles surrounding social media content and its use.

3.5 hours Continuing Legal Education (CLE) credit including 1 hour of technology credit.

Presenter: Sabrina Rockoff

  • An overview of the implications of social media on tort law 

10:40 a.m. – 11:40 a.m. - Social Media in the Courtroom

Presenter: Milton Fletcher

  • Authentication and foundation requirements
  • Effectively challenging the use and admissibility of evidence
  • How best to use this evidence before a judge and jury

11:45 a.m. – 12:45 p.m. - Social Media: Pretrial Issues

Presenter: Alex Gomes

  • Advising clients about their online activity during pendency of litigation
  • Capturing and preserving social media content
  • Drafting and responding to discovery requests relating to social media
  • Handling social media content of third parties

PRESENTERS

Sabrina Rockoff is the Managing Partner of the McGuire, Wood & Bissette law firm in Asheville. A double Tar Heel, she graduated from UNC Law School in 2002 and UNC-Chapel Hill in 1999. Her practice areas include employment law and litigation. She is among the Legal Elite recognized by Business North Carolina Magazine, as well as the Super Lawyers® from 2011 through 2021 for Employment law.  Among her many community activities, she serves as Board Chair of The Mediation Center.

Milton Fletcher is an Assistant District Attorney in the 35th Prosecutorial District, has eleven years of experience as a prosecutor, and is a board-certified criminal law specialist. A graduate of Wake Forest Law School, he received his bachelor’s degree from Ole Miss. Milton is a frequent speaker at trainings organized by the North Carolina Conference of District Attorneys, presenting on evidentiary issues to prosecutors all across the State.

Alex Gomes is a NC Board Certified Specialist in Family Law, and he represents clients for all family-law related matters at Montford Family Law.  Alex graduated in from the University of Florida with a B.S. in Business Administration and earned his J.D. from the North Carolina Central University School of Law. After working for five (5) years as an attorney at Pisgah Legal Services with the Mountain Violence Prevention Project, Alex joined Montford Family Law in January 2012. In 2011, Alex was appointed by the Governor to the North Carolina Council for Women Board, on which he held the distinct honor of being the first male appointed.  Alex received the “Outstanding Volunteer Lawyer Award” from the 28th Judicial District Bar & Pisgah Legal Services in 2019, and is a member of the NC Bar Association’s Family Law Council as well as the Harry C. Martin American Inns of Court.
